An article in the September 17 issue of Part B News, “Medicare exclusions not just for OIG anymore: RFK Jr.,” discussed various types of possible disciplinary actions against Medicare providers. Rivkin Radler’s Chris Kutner was quoted in the article.

“I don’t think there’s a percentage of the population that really understands the distinction between preclusion, revocation and exclusion,” Chris said. “So when clients call and say, ‘you know, we got this letter from CMS or OIG,’ I say: ‘Get me the letter quickly so that I can see the language, because the appeal rights and time frames are not the same in all cases.’”

Chris expects further variability in disciplinary correspondence now that exclusion authority will be shared between the Office of Inspector General (OIG) and Centers for Medicare & Medicaid Services (CMS).
